(EB5) Immigration visa
EB5 USA Green Card Visa is an excellent American Permanent Residency opportunity for individuals with a qualifying net worth, and for their dependent families. It permits the applicant to immigrate to the nation through US Green Card with dependent spouse and children below 21 years. Enjoy all the benefits of having Green card by eliminating competition with other non resident of USA, like getting into the best school for your children and pay fees as per resident criteria. EB5 Visa as it is an employment based preference immigration category that requires the applicant to be involved with a new commercial enterprise in the US which benefits the American economy, by creating at least 10 full time i.e. direct or indirect jobs.
We provide a safe and robust structured pathway for investment in accordance with USCIS immigration scheme guidelines, while the applicant may not be involved in day-to-day operations of the invested commercial enterprise, he must have at least a policy level role. If the person is investing in an existing commercial enterprise that business must have been established after November 29, 1990.
Normally, an annual quota of 10,000 visas is identified under the EB5 Visa category. Under a pilot program, at least 3000 of this quota have been set aside for designated regional centers for the EB5 Visa. Post approval of the EB5 application, a conditional Green Card is issued to the applicant (and spouse and dependent children). After 36 months of holding the conditional EB5 Green Card, the applicant applies for removal of condition and the applicant (and spouse and dependent children) can get Permanent Green Card after providing evidence that the investment lead to creation of 10 US jobs during the conditional status. Once proven, the condition is removed thereon.
TEA And Non TEA
The minimum qualifying investment in the United States is $1 million or minimum qualifying investment either within a Targeted Employment Area (TEA) is $500,000
A targeted employment area is an area that, at the time of investment, is a rural area or an area experiencing unemployment of at least 150 percent of the national average rate.
A rural area is any area outside a metropolitan statistical area (as designated by the Office of Management and Budget) or outside the boundary of any city or town having a population of 20,000 or more according to the decennial census.
Job Creation Requirements
Create at least 10 full-time jobs (direct or indirect) for qualifying U.S. workers within two years of the immigrant investor’s admission to the United States as a Conditional Permanent Resident.
Direct jobs are actual certain jobs for qualified employees located within the commercial enterprise into which the EB5 investor has directly invested his or her capital.
Indirect jobs are those jobs shown to have been created collaterally or as a result of capital invested in a commercial enterprise associated with a regional center by an EB5 investor. An investor may only use the indirect job calculation if associated with a regional center.
Role of Regional Centre:
An EB5 Regional Center is an organization nominated by United States Citizenship and Immigration Services (USCIS) that sponsors capital investment projects for investment by EB-5 investors. The major advantage for regional center designation is that the regional center can take advantage of indirect job creation. Regional centers help EB5 investors and project developers because they reduce the difficulty of meeting qualifying job creation requirements under the EB5 program rules.
